Resolved Question: Would you live on a residential pier?
I don’t know if these are already being made, so I’ll ask anyway. If you were a resident of a coastal city, what would think about a pier that had several houses and what have you? Would you want to live in a place like that? Say if you live in Los Angeles, for example. Would you support a local city plan to construct several piers that have apartments, condominiums, or rowhouses on them? Do you agree they might help mitigate urban sprawl? Why or why not?

Resolved Question: cheap palettes? (good quality)?
I’ve recently started a profession as a traveling makeup artist. I go to a woman’s house before they go out and I do their makeup. I have about 15 regular clients, but I often get random calls: very last minute, very little planning. Pretty much, they show me a picture and I’m expected to have the colors and recreate the look.
The problem is, with this job i need so many eyeshadow colors! I absolutely adore the expensive products (i.e. MAC, Benefit, etc.) but when buying in bulk, I tend to spend more than I make. I need some recommendations of palettes that have 60 colors or more for under $40. I already have (and love) the following:
-Coastal Scents 88 matte and shimmer (2 separate palettes)
-Amuse 154
-Manly from Beauties-Factory 120
-Red Ginger 96

I’m looking for maybe two more like this. All help is appreciated.

PS: because of hygiene, I like to change brushes regularly. I’m also looking for cheap (no more than $5 a brush) brushes. I’ve tried ELF, but one of my clients says the bristles burn her eyes.

Voting Question: Does it make more financial sense to purchase a single family house or a condo? +What are the tax advantages?
I am a first time home buyer in Louisville, KY looking to purchase a home for my new family. We have an infant and don’t plan to have any more than one more child. I am, also, aware of the $8000 tax credit if purchased this year, and we plan to take full advantage of the credit if at all possible. Additionally, I am aware that condos typically have maintenance fees, but are often times much cheaper than self maintaining a home plus any included amenities. My real question is which investment class will I be happier with and generate the most ROI from in the future? We may also need to consider the investment’s liquidity as we may want to “Go coastal” in the next couple years, but we are tied to Louisville, KY for now.

Tackling Foreclosure: A Step By Step Guide

At any time any foreclosure case is registered, a structured process follows. In a judicial state, foreclosure begins as it is filed; in a non-judicial system, foreclosure begins once the Notice of Trustee Sales or the Notice of Default is filed. The beginning marks the pre-foreclosure stage, or the preparation before the actual handling of the case -the time when you can make the most money out of the case.

Order a Trustee Sale Guarantee, otherwise known as the TSG -this is just another name for a Trustee Report.

Sending notice to every person or entity that has a beneficial interest in the property: This would include everyone who has a lien on the property, including mechanic’s liens, a second mortgage, or the IRS.

Substitution of Trustee-Non judicial legal process: There’s always a Substitution of Trustee. To be clear, here are the 3 key parties in this type of process or case:

The Trustor, the one who borrowed the money, The Trustee who is a beneficiary, The Trustee, the one oversees the process

You may see a Substitution of Trustee posted at the County Recorder’s Office. This trustee only handles foreclosures and will follow the process to the end.

The Posting of Legal Notices -As required by law, as the affair concerns land and property, it should be made public through a legal notice. This notice contains only the information valid for public consumption; in other words, nothing that might be detrimental to the case or the parties involved. The notice appears on newspapers, publications, even special county-owned legal publications, and on the site of the property itself.

Maintaining constant contact -Constant contact should be maintained with the title company to ensure that no liens remain attached to the property being foreclosed. Bankruptcy can put a halt to the foreclosure, as bankruptcy is handled by federal law, superseding state law.

The Credit Bid -The credit bid is the set price when auctioning off the property. This is usually prepared by the mortgagee, or the beneficiary.

As dictated by state law, the credit bid is determined by the principal balance plus arrears:

Bank Interest, Penalties, All legal fees. Arrears can include homeowner fees, and second mortgages. In a judicial system, it’s the attorney who will handle the preparation of the credit bid; in a non-judicial system, it’s the trustee.

Payment-includes reinstating the loan, a task reserved for the owner. Suspension or cancellation of the sale -This can be done at any time by the mortgagee or beneficiary, provided prior arrangements have been made with the owner.

The Notice of Trustee Sale. This contains the time and place of the auction. This should also contain the proper legal descriptions of the property -which can be obtained at the County Tax Assessor’s Office. Take care to be sure that the description matches the actual address; it should be up-to-date, as addresses change overtime.

The Due on sale clause. This is a part of the mortgage that demand full payment of the loan, should the house be sold or transferred. The lender has no power to halt the sale, but can legally demand for full payment -which, in the lender’s case, has the same financial effect.

In the absence of a Due on Sale clause, the loan is assumable without the lender’s consent. Older FHA and VA loans are assumable without the consent of the lender. How does this impact the sale of a foreclosed property? If you get a warranty deed from the owner at the time of the foreclosure sale or in the pre-foreclosure timeframe, as long as you keep making the payments, the bank will most likely be not be aware of the transfer. If you buy the property and then sell it immediately or even later on, you will be fulfilling that requirement of paying off the loan at that time.

Legal Protection Through Errors and Omissions Insurance

We live in an extremely litigious era, and no matter how unintentional a mistake might have been, or how baseless a client’s claim might be, many people turn immediately to the courts and file law suits to seek some kind of compensation for damages real or perceived. This is where companies and individuals can turn to Errors and Omissions insurance for legal protection in these circumstances.

When a customer or client attempts to hold you or your company responsible for errors or failure to complete work as specified in a contract, Errors and Omissions insurance can cover you. Any contract performance dispute can be serious problems for a company, but the right insurance program can help you work through it.

This type of insurance can be applied to almost any business, but it is especially useful to a company in the services industry. When you offer a service for a fee, you don’t have as much tangible proof that the job was done correctly. That’s why customer will more often try to dispute those results and turn to litigation.

Think of Errors and Omissions insurance like you would malpractice insurance. Both of these policies are there because sometimes, despite your best efforts, things just go wrong. And when it is a costly something and the client seeks compensation for the error, this kind of insurance can be a lifesaver.

And sometimes there are situations that are just out of your control, and no matter how much effort you put into finishing the task or job as it was outlined in the contract, it just can’t be done. It might be because of an underperforming employee, or a debilitating accident on the job. The thing to remember is that while it may not have been your fault, that doesn’t mean the customer won’t seek compensation. Will you be ready for it?

Different insurance companies will, of course, offer different levels of Errors and Omissions protection, and you should make the sure coverage is right for you. There may be some options you don’t need, and there are some features you don’t want to miss. Either way, make sure that you understand your policy and how it will protect you.

Your policy should at the very least cover all possible judgments against you and any of the court fees and lawyer costs that are associated with litigation. Whenever you go to court, these costs can quickly add up and hurt your company if you can’t afford them all. The policy should also cover you whether the error was made by a W2, full time employee or a 1099 subcontractor.

Many companies can forget about Errors and Omissions insurance or simply believe that they don’t really need it. After all, their service has been universally loved and praised so far. But all it takes is one litigious customer to make problems. You can avoid them all with the right insurance policy.

Maintain Accurate Records While Renting

As a landlord of one of the rental homes in Utah, be sure to know how to keep good written records. They need to be accurate and well organized to make sure you have all the correct information on your rental home and on tenants for your documents.
